Legal guarantee

When you shop at lusja.sk as a consumer, you have statutory rights relating to the seller's liability for faulty goods, commonly referred to as the legal guarantee. These rights are free of charge and do not depend on purchasing an additional guarantee.

EU harmonised notice

The official European Union notice explains consumers' basic rights under the legal guarantee of conformity. We display it without modifications.

Which defects are covered, and for how long?

As the seller, we are liable for defects that existed when the goods were delivered and become apparent within two years of delivery. This includes, for example, goods that do not match the agreed description or lack agreed or reasonably expected characteristics and functionality. For second-hand goods, we may agree on a shorter period, but never less than one year from delivery.

For contracts concluded on or after 31 July 2026, the seller's liability period is extended by 12 months after the first repair that remedies a defect. This extension applies only once, regardless of the number of repairs. Claims under earlier contracts are assessed under the legislation applicable to the relevant contract.

Normal wear consistent with use of the goods, or damage caused by improper use, does not in itself constitute a defect for which the seller is liable. We assess each claim according to its particular circumstances.

What are your rights?

If we are liable for a defect, you may choose a free repair or replacement. Your chosen remedy must be possible and must not impose disproportionate costs on us compared with the other remedy. We will arrange the repair or replacement at our expense and without significant inconvenience to you.

Subject to the statutory conditions, you are entitled to a proportionate price reduction or to terminate the sales contract and receive a refund. This may apply, for example, if we fail to remedy the defect properly and in time, refuse to remedy it, the same defect persists after repair or replacement, or the defect is serious enough to justify an immediate price reduction or termination. You cannot terminate the contract for a negligible defect.

How to make a claim

Notify us of the defect within two months of discovering it, and no later than the end of the applicable liability period.

  1. Email lusja@lusja.sk, report the defect in person at our premises, or notify us in writing at our registered office address below.
  2. Provide your contact details, identify the goods, describe the defect and state your preferred remedy. To verify the purchase, provide your order number or proof of purchase, such as an invoice or another document showing that you bought the goods from us. You may attach photographs to help us assess the defect.
  3. For repair or replacement, hand over the goods or make them available to us. For bulky or installed goods, contact us so that we can arrange access.

We will promptly provide written confirmation of your defect notification and state the deadline for remedying the defect. We will remedy it within a reasonable period, no more than 30 days from notification, unless an objective reason beyond our control justifies a longer period. If we deny liability, we will explain our reasons in writing.

Legal and commercial guarantees

A manufacturer or seller may also offer a voluntary commercial guarantee. Its scope and conditions are set out in the relevant guarantee statement. Such a guarantee does not replace or restrict your statutory rights against the seller.
